Event Participation & Liability Waiver

1. Assumption of Risk

Metal detecting and outdoor activities carry inherent risks, including but not limited to:

• Uneven ground and hidden hazards
• Livestock and agricultural environments
• Adverse weather conditions
• Physical exertion
• Use of tools and metal detecting equipment

By attending any Heart of Scotland Charity Digs event, you voluntarily accept all risks associated with participation.

2. Personal Responsibility

By attending, you agree that:

• You are responsible for your own safety and wellbeing.
• You will follow all instructions given by organisers.
• You will comply with landowner permissions and event boundaries.
• You will follow the Countryside Code and all relevant UK laws.
• You hold appropriate public liability insurance (e.g., NCMD membership).

3. Equipment

You are fully responsible for your own equipment and its safe use. Heart of Scotland Charity Digs accepts no responsibility for loss, theft, or damage to personal property.

4. Limitation of Liability

To the fullest extent permitted by law, Heart of Scotland Charity Digs, its organisers, volunteers, and landowners shall not be liable for:

• Injury or illness
• Loss or theft of property
• Damage to personal belongings
• Any direct or indirect losses arising from participation

Nothing in this waiver excludes liability for death or personal injury caused by negligence or any other liability that cannot be excluded by law.

5. Legal Compliance

Participants are responsible for complying with Scottish Treasure Trove law and any other relevant detecting regulations. All qualifying finds must be reported in accordance with legal requirements.

6. Conduct

We reserve the right to remove any participant who:

• Acts in an unsafe or irresponsible manner
• Fails to follow event rules
• Damages land, property, or crops
• Disrupts the event or other participants

No refund will be given in such cases.

7. Photography & Media

Photographs and video may be taken during events for promotional, social media, and charity purposes.

If you do not wish to appear in media content, please inform an organiser at the event.

8. Agreement

By registering for or attending a Heart of Scotland Charity Digs event, you confirm that you have read, understood, and agree to this Event Liability Waiver.
